5/6/2026—Division 2 of Breckinridge Circuit Court with Judge Kenneth H. Goff II met Wednesday.

 

Ernie L. Dean, 65, pleaded not guilty to 1st degree possession of a controlled substance(meth), 2nd offense.  In another case, Dean pleaded not guilty to 1st degree fleeing/evading police; 1st degree criminal mischief; 1st degree wanton endangerment/police officer; 1st degree wanton endangerment; 1st degree possession of a controlled substance(meth), 1st offense; failure of owner to maintain required insurance, 2nd or greater offense; operating a motor vehicle under the influence of a controlled substance; operating a motor vehicle with an expired license; and possession of marijuana.  A pre-trial conference was scheduled for June 17.

 

Todd A. Jones, 35, pleaded not guilty to 2nd degree assault; 1st degree unlawful imprisonment; and two counts of 4th degree assault/minor injury.  A pre-trial conference was scheduled for July 8.

 

Samuel R. Moore, 38, pleaded not guilty to 1st degree possession of a controlled substance(meth), 1st offense.  A pre-trial conference was scheduled for May 20.

 

Mary L. Sarver-Douthitt, 49, pleaded not guilty to 2nd degree burglary.  A pre-trial conference was scheduled for July 8.

 

Robert M. Coffey, 32, pleaded not guilty to receiving stolen property valued between $1,000 and $10,000 and obscuring the identity of a machine valued between $500 and $10,000.  A pre-trial conference was scheduled for July 8.

 

Jo Elliot Marcum, 43, pleaded guilty to 1st degree trafficking in a controlled substance(meth), 1st offense; 2nd degree trafficking in a hallucinogen, 1st offense; trafficking in marijuana; possession of drug paraphernalia; and public intoxication/controlled substance.  Sentencing was scheduled for July 8.

 

Kevin Payne, 46, was sentenced to 14 days in prison, credited for time served, for contempt of court.

 

Glen R. Nelson, 53, pleaded guilty to 1st degree sexual abuse.  Sentencing was scheduled for July 8.

 

Kenneth D. Bishop, 50, pleaded guilt to flagrant non-support.  Sentencing was scheduled for July 8.

 

Johnathan T. Morgan, 32, pleaded guilty to two counts of 2nd degree wanton endangerment and 1st degree possession of a controlled substance(meth), 1st offense.  Sentencing was scheduled for July 8.

 

James L. King, 45, pleaded guilty to 1st degree possession of a controlled substance, 3rd or greater offense. In another case, he pleaded guilty to 2nd degree fleeing/evading police; 2nd degree wanton endangerment/police officer; and failure of non-owner to maintain required insurance, 1st offense.  Sentencing was scheduled for July 8.

 

Benjamin C. Ferry, 61, was sentenced to ten years in prison, probated for three years, for theft by unlawful taking of an auto valued between $1,000 and $10,000.
