3/7/2024—Division 1 of Breckinridge Circuit Court with Judge Bruce Butler met Wednesday.

 

Amber D. Brothers, 36, pleaded not guilty to theft by unlawful taking of property valued between $1,000 and $10,000.  A pre-trial conference was scheduled for May 8.

 

Robert Wise, 35, pleaded not guilty to flagrant non-support.  A pre-trial conference was scheduled for May 8.

 

Dakota J. Donahue, 18, pleaded not guilty to 2nd degree rape/no force.  A pre-trial conference was scheduled for May 8.

 

James Hines, 47, pleaded not guilty to 1st degree possession of a controlled substance(meth), 3rd or greater offense.  A pre-trial conference was scheduled for May 8.

 

Donald Thompson, 33, pleaded guilty to 1st degree possession of a controlled substance(meth), 1st offense.  He was sentenced to 18 months in prison, diverted for three years.

 

Jerry J. Whitehead, 45, pleaded not guilty to receiving stolen property valued over $10,000.  A pre-trial conference was scheduled for May 8.

 

David L. Thurman, 44, pleaded not guilty to 1st degree sodomy/victim under 12 years of age; 1st degree sodomy; 1st degree sexual abuse/victim under twelve years of age; and 1st degree sexual abuse.  A pre-trial conference was scheduled for May 8.

 

Robert J. Reesor, 41; Adam B. Bauer, 36; and Joshua L. Duncan, 28; and Misty A. Miller, 44, each pleaded guilty to 1st degree possession of a controlled substance(meth), 1st offense.  Sentencing was scheduled for April 24.

 

Philip L. Taylor, 32, pleaded guilty to 1st degree possession of a controlled substance(meth), 1st offense/enhanced and trafficking in marijuana, 1st offense/enhanced.  Sentencing was scheduled for April 24.

 

Joseph D. Bratcher, 35, pleaded guilty to 1st degree attempted sodomy/victim under twelve years of age; two counts of 1st degree sexual abuse/victim under twelve years of age; 1st degree sexual abuse; and being a 2nd degree persistent felony offender.  Sentencing was scheduled for May 22.

 

Robert N. Brown, 33, pleaded guilty to theft by unlawful taking of a controlled substance valued under $10,000, and being a 1st degree persistent felony offender.  Sentencing was scheduled for April 24.

 

Chad E. Flood, 50, was sentenced to 18 months in prison for 1st degree possession of a controlled substance(meth), 1st offense, and 12 months for possession of drug paraphernalia.  The sentences will run concurrently for 18 months and probated for three years consecutively.

 

Joy S. Schilmiller, 55, was sentenced to two years in prison on each of two counts of 2nd degree forgery; two years for fraudulent use of a credit card valued between $1,000 and $10,000; one year for 2nd degree criminal possession of a forged instrument; 12 months for theft/receipt of a stolen credit/debit card; and 90 days for theft by unlawful taking.  The sentences will run concurrently and consecutively for a total of five years, probated for five years.

 

Motions for shock probation by Dwayne E. Vincent, 39, and Timothy Cundiff, 43, were taken under submission.
