Breckinridge Circuit Court-Division 2

11/6/2019—Division 2 of Breckinridge Circuit Court with Judge Kenneth H. Goff II met Wednesday.

Danielle Marie White, 26, pleaded not guilty to 1st degree promoting contraband.  A pre-trial conference was scheduled for January 7, 2020.

Darla J. Jones, 38, pleaded not guilty to 1st degree possession of a controlled substance(meth), 1st offense, and possession of drug paraphernalia.  A pre-trial conference was scheduled for December 18.

Co-defendants Barry J. Kerr, 45, and Shawn D. Coogle, 37, pleaded guilty to 2nd degree criminal mischief.  They were sentenced to twelve months in prison, and one year conditional discharge.

Co-defendants Katelyn Houchin, 23, and Leslie Houchin, 43, pleaded guilty to theft by deception, including cold checks valued under $10,000.  They were sentenced to twelve months in prison, probated for twelve months.

Mark A. Eck, 54, will have a jury trial May 27, 28, 2020.  He is charged with 1st degree possession of a controlled substance(meth), 1st offense, and possession of drug paraphernalia.

Janet L. Armes, 50, pleaded guilty to operating a motor vehicle under the influence, 4th or subsequent offense.  Sentencing was scheduled for December 4.

Carl W. Warner, 28, pleaded guilty to 1st degree wanton endangerment, and 1st degree driving under the influence.  He was entered in the pre-trial diversion program.

Co-defendants Phillip L. Taylor, 28, and Misty A. Miller, 40, pleaded guilty to 3rd degree burglary, and two counts of theft by unlawful taking of an auto valued under $10,000.  They were entered in the pre-trial diversion program for three years.

Jerry L. Lucas, 25, will have a jury trial February 13,14, 2020.  He is charged with theft by unlawful taking of property valued between $500 and $10,000; tampering with physical evidence; reckless driving; no operators license; failure to maintain insurance; expired registration receipt; no registration plates; leaving the scene of an accident; and being a 1st degree persistent felony offender.

Daniel T. Ashley pleaded guilty to theft by unlawful taking of an auto valued between $500 and $10,000; two counts of 1st degree wanton endangerment of a police officer; 3rd degree assault; 1st degree fleeing/evading police; two counts of carrying a concealed deadly weapon; operating a motor vehicle with a revoked license; speeding; reckless driving; improper passing; disregarding a stop sign; and disregarding a traffic control device.  Sentencing was scheduled for December 4.

Brandon Rhodes, 26, pleaded guilty to 1st degree possession of a controlled substance(meth), 1st offense.  Sentencing was scheduled for December 4.

James R. Kelly, 31, was sentenced to three years in prison, probated, for flagrant non-support.

Gene L. Smallwood, Jr., 38, was sentenced to six years in prison, probated for five years, for theft by unlawful taking of property valued between $500 and $10,000; and receipt of a stolen credit card.
